Although our firm represents some of the world’s largest manufacturers in the energy, automotive, and medical device fields as well as some of the world’s largest financial service providers (including some of Israel’s largest insurance companies), you will not find on our web site any mention by name of our foreign clients (with very few exceptions, such as the U.S. Securities and Exchange Commission). Such anonymity is intentional.
Under Israeli law, if an entity adverse to one of our existing clients were to want to sue that client in Israel, the greatest disservice that our firm, as Israeli counsel, could do to our client would be to list its name on our web site, because such listing would assist the party adverse to our client in arguing before an Israeli court that our firm is a proper “address” for service of process upon our client.
In this respect, Israeli law is more formalistic than (for example) US law, on the issue of jurisdiction over foreign companies.
While it might seem to non-Israeli lawyers that the mere presence of a foreign company’s name on a law firm’s web site should be of marginal relevance to the issue of jurisdiction, Israeli case law has held that an “intensive connection” between an Israeli lawyer and a foreign company is a sufficient basis on which to permit the exercise of jurisdiction even in connection with matters unrelated to those that the Israeli lawyer previously handled for that client.
In light of the above, and because we prefer not to expose any of our clients to the risk of being sued in Israel, we refrain from identifying any of them by name on our site.
