At the outset of virtually any international legal dispute (whether in court or in arbitration), counsel for the plaintiff and counsel for the defendant must take into consideration the enforceability of any eventual judgment (or award) in the jurisdiction(s) where the defendant has assets. A plaintiff’s lawyer who fails to consider such issue takes the risk that his client will spend time and money to obtain a judgment that is worthless, and a defense lawyer who fails to consider such issue runs the risk that his client will spend money needlessly defending a suit before a court that (for example) does not have jurisdiction to adjudicate the dispute. (These issues are discussed in greater detail in our Primer On Litigation In Israel.)
 
Eric Sherby is recognized internationally as an expert in the field of enforcing foreign judgments and arbitral awards. He successfully enforced a Canadian judgment before the Israeli Supreme Court, and he has successfully enforced, before Israeli trial courts, judgments from the United States, the UK, and Germany. Mr. Sherby has never had an enforcement action denied. In addition, Mr. Sherby has, in several cases, been retained by other Israeli lawyers to provide expert testimony before Israeli courts concerning the enforceability of US judgments. He has also provided expert testimony to American courts regarding the enforceability of Israeli judgments.
