As described in our blog post of July 29, the Israeli government is considering a proposed statute (the \u201cProposal\u201d) to regulate the (in-bound) medical tourism industry.<\/p>\n

As suggested in the July 29 post, there is reason to believe that, to a large extent, (a) the Proposal is an attempt to redirect business from certain players in the private sector to hospitals, and (b) the altruistic purposes set forth in the summary of the Proposal are secondary.<\/p>\n

In this and subsequent posts, we review some of the restrictions that the Proposal imposes upon \u201cagents,\u201d and we examine whether those restrictions confirm the suspicion that the Proposal is intended to favor some economic actors over others.<\/p>\n

We start with the most important definitions under the Proposal \u2013 the terms \u201cmedical tourism\u201d and \u201cagent.\u201d<\/p>\n

The term \u201cmedical tourism\u201d is defined in the Proposal (in relevant part) as<\/p>\n

\u201cEntry of a person, who is not a citizen of Israel or a resident of Israel, from another state, into Israel, for the purpose of receiving medical treatment that is planned in advance in a medical institution in Israel.\u201d<\/p>\n

The term \u201cmedical tourism agent\u201c is defined simply as someone who is registered as such an agent with the Ministry of Health.<\/p>\n

Section 4 of the Proposal provides that, in order to engage in \u201cbrokering\u201d or \u201cmiddleman\u201d services between a known medical institution and a medical tourist, a person must be registered<\/em><\/strong>.<\/p>\n

Section 13 provides:<\/p>\n

\u201can agent [broker\/middleman] shall not condition the provision of services or contracting with a medical tourist upon the acquisition of services that are not part of the medical treatment offered by the medical institution.\u201d<\/p>\n

The kind of conduct prohibited by section 13 is sometime called \u201ctying.\u201d<\/p>\n

Presumably the no-tying rule is intended to prevent an agent who works with medical tourists from taking advantage of his superior familiarity with (for example) the Israeli hotel market \u2013 it would not seem proper to allow an agent to condition his arranging for medical services upon the medical tourist\u2019s booking a hotel stay at a five-star hotel (which might have an arrangement with the agent to pay a commission) as opposed to a three or four-star hotel.\u00a0 (The same concern would apply to ground transportation or cell phone rentals in Israel; the examples are unlimited.)<\/p>\n

But the altruistic purpose of ensuring that no medical tourist gets taken advantage of seems very suspect when we examine the players<\/em><\/strong> in the Israeli medical tourism sector together with the definition in section 4.<\/p>\n

A quick Internet search (for \u201cmedical tourism in Israel\u201d) reveals that major Israeli providers of medical services \u2013 including Hadassah Medical Center, Herzliya Medical Center, and Assuta Medical Center<\/em><\/strong> \u2013 actively target, on their web sites, non-Israeli medical tourists.\u00a0 This suggests that the size of the medical tourism industry is such that major Israeli hospitals and health care providers want to get a piece of the action.<\/p>\n

Is there anything in the Proposal that would prevent Hadassah, Herzliya, or<\/em> Assuta<\/em> <\/strong>from engaging in tying?\u00a0 The answer is no<\/em>, because Hadassah, <\/strong>Herzliya, and Assuta (and their like) do not fall within the definition of a \u201cbroker\u201d or \u201cmiddleman\u201d in section 4.\u00a0 Why not?\u00a0 Because an entity cannot act as a \u201cbroker\u201d or a \u201cmiddleman\u201d with itself<\/strong>.<\/em><\/p>\n

Thus, even though the major hospitals clearly do compete<\/em> for business<\/em> with the (presumably smaller) medical tourism brokers, the definition of \u201cengaging in brokering or middleman services\u201d does not cover hospitals \u2013 which means that hospitals may (for example) condition providing their medical services upon the medical tourist\u2019s agreeing to book his stay at a particular hotel.<\/p>\n

In other words, when it comes to \u201ctying,\u201d the hands of the independent agents are tied whereas the hands of the hospitals remain untied.\u00a0 (No pun intended.)<\/p>\n

The above means that, if the Proposal were to become law, the playing field in the medical tourism sector would be far from even.\u00a0 That seems far a field from the altruistic purposes of the proposed statute.<\/p>\n
